De Facto Relationships
A de facto relationship is defined in the Act as being in a relationship with another person but not legally married to each other, you are not related by family and you have a relationship as a couple living together on a genuine domestic basis.
Usually, you will need to demonstrate that you have lived together for at least two years. This is overlooked if there is a child of the relationship, or in other exceptional circumstances.
A de facto relationship can exist between 2 persons of different sexes and between 2 persons of the same sex.
